Jharkhand Anti-Cheating Bill: end of an odd tradition?

The Jharkhand Competitive Examination (Measure for Control and Prevention of Unfair Means in Recruitment) Bill, 2023, or as we know in the layman’s language the Anti-cheating bill was approved by the state legislative assembly, bringing the Hemant Soren-led government one step closer to enacting unprecedented punitive provisions against those who cheat in competitive examinations.

According to the anti-cheating bill in Jharkhand, individuals convicted of cheating in a competitive examination could face the following penalties:

  1. First-time offenders: They may be sentenced to one year in jail.
  2. Repeat offenders: They could face a jail term of up to three years.

What does this mean?

An “anti-cheating bill” is often legislation or legal measures designed to prevent and penalize various forms of cheating and academic dishonesty, notably in educational institutions.

These measures are intended to address issues like as plagiarism, exam cheating, and other forms of dishonest behavior that damage educational systems’ legitimacy.

What is the need for an anti cheating bill?

As we all know, board examinations or any state level exams in Jharkhand and Bihar have always been a shambles. We’ve all grown up hearing about it in the news, how papers are leaked and copied before exams and students openly exploit these as they don’t have any other way to pass the exam.

The need for an anti-cheating bill, particularly in the context of educational and competitive tests, stems from a number of significant factors:

Maintain Academic Integrity: Cheating jeopardizes the credibility of educational systems and competitive examinations. It diminishes the efforts of honest students and undermines educational institutions’ reputation.

Fairness: Cheating gives individuals who participate in dishonest behavior an unfair advantage. It can lead to educational and employment inequities, rewarding those who cheat over those who work hard and follow the rules.

Education Quality: A bill against cheating promotes educational institutions to maintain high academic standards and to foster genuine learning. When cheating is prevalent, educational quality diminishes because students may focus on shortcuts rather than comprehending the subject content.

Legal Framework: These bills establish a legal framework for dealing with incidents of cheating, ensuring that due process is followed when complaints are made and that suitable sanctions are imposed.

What does this anti cheating bill proposes?

The Jharkhand government recently passed legislation aimed at discouraging exam cheating and guaranteeing a fair and timely examination procedure for government positions.

The bill provides harsh penalties on individuals who gain unauthorized access to examination papers, including life imprisonment and fines of up to Rs 10 crore.

These rigorous provisions are meant to deter examinees, as well as employees of test authority, printing press workers, transportation people, and coaching institutes, from attempting to manipulate the examination process.

The bill aims to protect the integrity of the state’s competitive tests. Due to a series of problems involving competitive examinations in the state, the Soren government in Jharkhand has realized the need for a tough anti-cheating law.

Notably, the Jharkhand Public Service Commission’s seven examinations for the selection of state public service employees have all been hampered by conflicts.

There have been numerous applications filed in the Jharkhand High Court alleging irregularities and corruption in these examinations and in an answer to these petitions this bill has been passed by the Jharkhand government taking a step forwards in a right direction of good, pure and right education.

Several Indian states, including Uttarakhand, Rajasthan, Chhattisgarh, Uttar Pradesh, Andhra Pradesh, and Odisha, have made steps to enact anti-cheating legislation or ordinances in order to improve transparency and fairness in competitive examinations in their respective regions.

Will it succeed in achieving its goal?

To be successful in combating cheating through legislation, a multifaceted approach combining legal measures with education, prevention, and enforcement is required. It is critical to acknowledge that no single solution is perfect, and that continual efforts are required to preserve the integrity of academic and competitive testing systems.

Encourage educational institutions to implement preventive measures such as creating an academic honesty culture, providing tools for appropriate citation, and deploying plagiarism-detection software.

Effective Enforcement: Ensure that the bill is consistently and impartially enforced. This may entail establishing dedicated authorities or units in charge of investigating and dealing with cases of cheating.

Whistleblower Protection: Give persons who report instances of cheating legal protection. This can motivate honest people to come forward without fear of retaliation.

Regular Review and Updates: The legislation should be reviewed and updated on a regular basis to accommodate evolving types of cheating and academic dishonesty. Keep up with technical changes that may enable new cheating methods.
